Botsi Inc. (“Botsi”, “we”, “us”, or “our”) is committed to protecting the privacy and security of your personal information. This Privacy Policy describes how we collect, use, disclose, transfer, and otherwise process your Personal Information. It also tells you about your rights with respect to your Personal Information, and how you can reach us to update it or get answers to questions you may have about our privacy practices.

For the purposes of this Privacy Policy, “Personal Information” refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. It does not include aggregated or de-identified information that is maintained in a form that is not reasonably capable of being associated with or linked to an individual.

This Privacy Policy applies to individuals who visit our website(s) and online properties (e.g., botsi.com) (collectively referred to as the “Website”) (“Visitors”) and individuals who register to use or who use our products and services (“Customers”). When we refer to “you” in this Privacy Policy, we are referring to Visitors and Customers collectively.

We may update this Privacy Policy from time to time to reflect changes to our information practices. If we make any material changes, we will notify you by email (sent to the email address specified in your account) or by means of a notice on our Website prior to the change becoming effective. Directly from you. We collect Personal Information directly from you when you provide it to us, such as when you register for an account, use our services, fill out a form, make a purchase, communicate with us, or participate in a survey or promotion.

Automatically. We automatically collect certain information when you visit, use, or navigate our Website and services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Website and services, and other technical information. From social networks.When you interact with our Website or services through various social media, such as when you log in through a social network, “like” us on Facebook, or follow us or share our content on Google, Twitter, LinkedIn, or other social networks, we may receive information from those social networks including your profile information, profile picture, gender, user name, user ID associated with your social media account, age range, language, country, and any other information you permit the social network to share with third parties. The data we receive is dependent upon your privacy settings with the social network. You should always review, and if necessary, adjust your privacy settings on third-party websites and social networks and services before linking or connecting them to our Website or services.

3. What Information We Collect

3.1 Botsi Visitor

If you are a Visitor to our Website, we may collect the following categories of Personal Information:

  1. Usage details. Information about how you access and use our Website, including your access times, pages viewed, links clicked, and the page you visited before navigating to our Website.
  2. Device information. Information about the computer or mobile device you use to access our Website, including the hardware model, operating system and version, unique device identifiers, browser type, and mobile network information.
  3. Location information. Information about your location, which may be determined through your IP address.
  4. Contact information. Information such as your name, email address, and any other information you provide to us when you fill out a form on our Website, such as when you request a demo or sign up for our newsletter.

  6. Social media information. Information from social media platforms when you interact with us on those platforms or access our social media content. This may include your user name, profile picture, and other profile information, your “likes” and other interactions with our content, and any other information you permit the social network to share with third parties.

3.2 Botsi Customer

If you are a Customer and use our services, we may collect the following categories of Personal Information in addition to the categories listed above:

  1. Transactional information. Information about the transactions you carry out through our services, including the type of service requested, date and time of the transaction, and transaction amount.
  2. Contact information. Information such as your name, email address, mailing address, phone number, and any other information you provide to us when you register for an account or communicate with us.
  3. Account and profile information. Information related to your account, including your user name, password, account settings, and preferences.
  4. Customer data. Information that you or your end users provide through your use of our services, including any data you upload, input, or transmit through the services.
  5. Usage information. Information about how you access and use our services, including your access times, features used, actions taken, and the pages you visited before and after navigating to our services.
  6. Device information. Information about the computer or mobile device you use to access our services, including the hardware model, operating system and version, unique device identifiers, browser type, and mobile network information.
  7. Location information. Information about your location, which may be determined through your IP address or other technical means.
  8. Crash and error reporting information. Information about errors, crashes, and other issues that occur when you use our services, which may include technical details about your device, what you were doing when the error occurred, and other diagnostic data.
  9. Survey information. Information you provide in response to a survey conducted by us or on our behalf.
  10. Social media information. Information from social media platforms when you interact with us on those platforms or connect your social media account with our services.

4. Information of Other Parties

(a) When our Customers use our services, they may provide us with information relating to their end users or other third parties. In these circumstances, Botsi acts as a “processor” or “service provider” on behalf of our Customers (the “controller” or “business”), meaning that we process such information on behalf of and under the instructions of the Customer. If you are an end user of one of our Customers, please contact the Customer directly for information about how your data is collected, used, and shared by them, and to exercise any rights you may have with respect to that data.

(b) Our Website and services are not directed to children under the age of 16, and we do not knowingly collect Personal Information from children under 16. If we learn that we have collected Personal Information from a child under the age of 16, we will promptly take steps to delete such information. If you believe that a child under 16 has provided us with Personal Information, please contact us at privacy@botsi.com. For the purposes of the Children’s Online Privacy Protection Act (“COPPA”), Botsi does not knowingly collect personal information from children under the age of 13.

5. Additional Information We May Obtain

We may supplement the information we collect from you with information obtained from other sources, including publicly available sources and third-party data providers. This supplemental information may include demographic data, interest data, and other information that helps us better understand our users and improve our services. We will treat the combined information in accordance with this Privacy Policy.

6. No Sensitive Data

We do not collect or process any “sensitive” or “special categories” of Personal Information, such as information relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, health data, or data concerning a natural person’s sex life or sexual orientation. We ask that you do not provide such information to us or through our Website or services.

9. How We Share and Disclose Information

9.1 We Do Not Sell Personal Data

We do not sell, rent, or trade your Personal Information to third parties for their commercial purposes. We have not sold Personal Information in the preceding twelve (12) months.

9.2 Service Providers; Business Partners

We may share your Personal Information with third-party service providers and business partners who perform services on our behalf, such as hosting, data analytics, payment processing, customer service, email delivery, auditing, and marketing. These third parties are authorized to use your Personal Information only as necessary to provide these services to us and are contractually required to maintain the confidentiality and security of your Personal Information.

We may also share your Personal Information between and among Botsi and any current or future parent, subsidiary, and/or affiliated company.

(a) Opt-Out of Marketing Communications. You may opt out of receiving marketing communications from us by following the unsubscribe instructions included in our marketing emails or by contacting us at privacy@botsi.com. Please note that even if you opt out of receiving marketing communications, we may still send you non-promotional messages, such as those about your account or our ongoing business relations.

(b) Cookies. Most web browsers are set to accept cookies by default. You can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Website and services.

(c) Do Not Track.Some browsers include the ability to transmit “Do Not Track” signals. We do not process or respond to “Do Not Track” signals. Instead, we adhere to the standards described in this Privacy Policy and applicable law.

(d) Account Information. You may update, correct, or delete information about your account at any time by logging into your account or by contacting us at privacy@botsi.com. Please note that we may retain certain information as required by law or for legitimate business purposes.

11. Data Processing and Data Transfers

We are based in the United States, and the information we collect is governed by U.S. law. By accessing or using our Website or services, or otherwise providing information to us, you consent to the processing, transfer, and storage of information in and to the United States and other countries, where you may not have the same rights as you do under local law. Where we transfer Personal Information from the European Economic Area (“EEA”), Switzerland, or the United Kingdom (“UK”) to a country that has not received an adequacy decision by the European Commission, we rely on appropriate safeguards, such as standard contractual clauses adopted by the European Commission, to transfer the data.

12. Security

We take reasonable measures to help protect your Personal Information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.

Our Website and services may contain links to third-party websites and services. We are not responsible for the privacy practices or the content of those websites and services. We encourage you to review the privacy policies of any third-party websites or services that you visit.

17. Privacy of Children

Our Website and services are not directed to children under the age of 16, and we do not knowingly collect Personal Information from children under 16. A.9 Nevada Residents

Under Nevada Revised Statutes Chapter 603A, Nevada residents may opt out of the sale of certain “covered information” (as defined under Nevada law) that we may collect. We do not currently sell covered information, as that term is defined under Nevada law.
